$10,000,000 awarded to injured worker

In a recent case, an injured worker was awarded $10 million dollars in compensation.

The 24 year old was employed on a rural property and suffered serious head and facial injuries as a result of a fall from a quad bike.  This accident left her in a vegetative state.

Following the accident she commenced proceedings and the evidence in Court showed that she was not properly trained to ride the quad bike and in addition to that she was allowed to ride it without wearing a safety helmet.  She was tasked to move some cattle that were found in the paddock beside the upturned bike.

The Court was satisfied that the instruction given to the injured person were inadequate, the cost and difficulty of giving proper instruction was slight and the risks were high.  Further the rear brakes of the quad bike were also inoperative at the time.  The court determined that the injured person lost control of the bike after striking a drain in the paddock, leading to her injuries.  She was awarded $10,000,000 in compensation.
